Terms and conditions of sale

These general terms and conditions govern the rights and obligations relating to the use of the services offered on the www.violeta-couture.ch website.

ARTICLE 1: SCOPE OF APPLICATION

1.1. The purpose of these general terms and conditions of sale is to govern the relationship between :

(i) Ms Violeta Lebedeva Brunko, operating a sole proprietorship as Violeta Couture, Rue de la Terrassière 43, 1207 Geneva ("Violeta Couture"); and

(ii) Any Internet user using the Site (the "Internet User") and designated as:

•  Buyer if the Internet User purchases one or more items online on the Site; or
• Seller if the Internet User has concluded a sales mandate with Violeta Couture in order for one or more of his/her items to be sold on the Violeta Couture Website (together with Violeta Couture, the "Parties" and each a "Party").

1.2. The Internet user accepts these general terms and conditions, as well as any subsequent amendments, each time he/she connects to and browses the Site. 

1.3. Violeta Couture reserves the right to amend these terms and conditions at any time and to replace the previous version with the most recent version on the Site.

ARTICLE 2: USE OF THE SITE

2.1 There is no right to use the Site or claim to the services of Violeta Couture. In particular, Violeta Couture may at any time exclude an Internet User, in particular in the event of a breach of these general terms and conditions, prohibit the use of the Site or remove a service offered on the Site, at its sole discretion.

2.2 By using the services offered by the Site, in particular by purchasing items offered for sale on the Site, the Buyer confirms that he/she is a natural person of at least 18 years of age and has full civil rights. Minors (under the age of 18) may not purchase items on the Site.

ARTICLE 3: PROTECTION OF PERSONAL DATA

3.1. Violeta Couture undertakes not to violate the privacy of Internet users and the confidentiality of the information provided.

3.2. The compulsory or optional nature of the data to be provided is indicated at the time of collection.

3.3 This data collection takes place in particular when an article is purchased and when contact is made with Violeta Couture +41 (0) 78 229 24 01 or info@violeta-couture.ch.

3.4. The personal data requested by Violeta Couture is necessary to ensure the proper management of sales and purchases made by Internet users via the Site, as well as to improve the quality of the service provided by Violeta Couture.

3.5. The Internet User accepts that Violeta Couture may keep all documents, information and records concerning his/her activity on the Website, in particular through the use of cookies.

3.6. The Seller accepts that Violeta Couture may communicate its personal data (surname, first name and email and postal address) to the Buyer, upon the latter's request.

3.3 By authorising the publication of the photos of his or her articles, the Seller assigns and transfers his or her copyright to Violeta Couture, which may freely use them for commercial and advertising purposes.

ARTICLE 4: ITEMS FOR SALE

A. Items for sale on the site

4.1. Violeta Couture carefully describes in detail the article offered for sale on the Site. The information provided is purely indicative, as are the photographs.

ARTICLE 5: ORDERS AND CONCLUSION OF THE CONTRACT

Violeta Couture confirme la réception de la commande par écrit, cette confirmation de commande vaut conclusion du contrat entre Violeta Couture et l’acheteur, Dans les cas exceptionnels où Violeta Couture ne confirme pas la commande, le contrat est formé entre Violeta Couture et l’acheteur au moment de la réception de la commande chez Violeta Couture, dès que Violeta Couture a accepté la commande en vue de la traiter. Les offres sont faites sans engagement ni obligation de la part de Violeta Couture. La même règle s’applique aux informations figurant dans les brochures et catalogues de Violeta Couture. Pour être valable, toute déclaration orale doit faire l’objet d’une confirmation écrite. Les dessins, illustrations, dimensions, poids ou autres caractéristiques sont donnés à titre indicatif et n’ont force obligatoire qu’après avoir fait l’objet, au cas par cas, d’une confirmation expresse écrite de la part de Violeta Couture. In the absence of an express written declaration to the contrary, this binding information shall remain valid until revoked by Violeta Couture, but for no longer than 2 months, and any condition to the contrary on the part of the Buyer (appearing, for example, in the latter's General Terms and Conditions of Sale) must be expressly accepted in writing by Violeta Couture. Violeta Couture reserves the right to modify these General Terms and Conditions of Sale without prior notice.

ARTICLE 6 : PrCES

The applicable prices are those in the Violeta Couture price list in force at the time of the order. All prices are in Swiss francs (CHF), ex works, plus VAT and packaging. Violeta Couture has the right to modify the price list and the prices shown therein at any time and without prior notice.

ARTICLE 7 : TERMS OF PAYMENT

Subject to any special terms of payment provided for in the partnership agreement, the following terms of payment apply to the purchaser: 30 days net, respectively from the date of the invoice. If the payment deadline is not met, interest on arrears of 9% shall be payable from the 31st day following the invoice date, without prior notice of default being required.

ARTICLE 8 : CHANGES TO ORDERS

Any modification of an order received and/or confirmed by Violeta Couture shall only be valid and binding if the said modification has been agreed in writing. Violeta Couture shall in all cases be authorised to invoice the Buyer separately for the administrative costs arising from the modification, as well as for the work already carried out.

ARTICLE 9 : DELIVERY

Delivery is made at the Buyer's risk. At the express request of the purchaser, Violeta Couture shall take out transport insurance for shipments; the costs arising therefrom shall be invoiced to the purchaser. Unless there are specific instructions from the Buyer, Violeta Couture is free to choose the method of shipment and the route of transport of the goods, without however guaranteeing the fastest and cheapest delivery of the said goods. Damage sustained during transport must be reported to the transport company without delay.

ARTICLE 10 : DELIVERY TIMES

Violeta Couture endeavours to respect, as far as possible, the delivery times agreed at the time of the order. However, compliance with these deadlines cannot be guaranteed. The impossibility of meeting an agreed deadline does not give the Buyer any rights whatsoever vis-à-vis Violeta Couture. In particular, delays do not give the buyer the right to refuse the goods, nor do they give him the right to compensation for costs resulting from the delay, nor to compensation of any kind. The delivery period shall be extended by an appropriate period if Violeta Couture does not receive the information required to execute the order in good time or if the order has been subsequently modified.

ARTICLE 11 : OBLIGATION TO INSPECT / CLAIMS FOR DEFECTS

The Buyer is obliged to inspect the goods delivered on receipt and to notify Violeta Couture in writing of any defects within 8 days of receipt of the delivery, enclosing the delivery note and/or a copy of the invoice with the complaint. Failure on the part of the purchaser to lodge a complaint shall constitute approval of the goods. Hidden defects must be reported in writing as soon as they are discovered and during the guarantee period.

ARTICLE 12 : WARRANTY / LIABILITY

Violeta Couture guarantees the promised quality of the goods shown on the order confirmation, in accordance with the following conditions: The products delivered are guaranteed against any material and/or manufacturing defect that may affect the product and render it defective or unfit for food use until the expiry of the consumption period. On the other hand, Violeta Couture cannot guarantee that its products are all identical, either visually or in terms of taste, as they are made from natural flowers that are subject to fluctuating weather conditions that can change their shape and the concentration of aromas they contain from one season to the next.
